The plain-language agreement for using Notate. By installing or using the extension, you agree to these terms.

The short version
- Notate is free for your first 25 issues; Pro is $5/month or $30/year for unlimited use, and the Service is provided as-is while we keep improving it.
- You're responsible for the feedback you create and where you export it.
- Use it lawfully — don't break things, abuse it, or annotate pages you have no right to.
- Connected tools like Linear and Jira have their own terms; those apply when you use them.
- To the extent the law allows, Notate comes without warranties and our liability is limited.
1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Notate ("Notate", "we", "us") governing your use of the Notate browser extension and this website at notate.live (together, the "Service"). By installing, accessing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
2. What Notate does
Notate is a browser extension that lets you leave pinned visual feedback on web pages — dropping pins, writing comments, capturing screenshots — and export that feedback to a connected issue tracker such as Linear or Jira. Features may change, grow, or be removed as the product develops.
3. Plans, billing, and availability
Notate offers a Free plan (25 issues, no card required) and a Pro plan ($5/month or $30/year, billed in advance and auto-renewing until cancelled). Pro subscriptions are managed through our payment processor and can be viewed, changed, or cancelled at any time from the extension's Settings → Billing. Cancelling stops future renewals; it doesn't retroactively refund a billing period already paid for, except as required by law or stated at checkout. The Service is under active development: features may be added, modified, or removed, and it may occasionally contain bugs or be temporarily unavailable. We may also change plans or pricing going forward; if we do, we'll make the terms clear before you're charged.
4. Your responsibilities and acceptable use
You agree to use the Service lawfully and responsibly. In particular, you agree not to:
- Use Notate to capture or annotate content you don't have the right to access or use.
- Infringe anyone's intellectual property, privacy, or other rights.
- Attempt to disrupt, reverse engineer, overload, or compromise the Service or the systems it connects to.
- Use the Service to store or transmit unlawful, harmful, or abusive content.
- Misuse the Service in any way that violates applicable laws or the terms of a connected tool.
5. Your content
The feedback you create — your pins, comments, and screenshots — is yours. As described in our Privacy Policy, this content is stored locally on your device, and we don't claim ownership of it. You're responsible for the content you create and for where you choose to export it.
When you capture a screenshot or annotate a page, you're responsible for ensuring you have the right to do so and that you handle any sensitive or third-party information appropriately.
6. Connected tools and third-party services
Notate can connect to third-party services such as Linear and Jira. When you connect one and export feedback, you authorize Notate to send that data to the service on your behalf. Your use of those services is governed by their terms and policies, not ours, and we're not responsible for their availability, behavior, or how they handle your data. Review their terms before connecting them.
7. Intellectual property
The Service itself — including the Notate extension, this website, and our name, logo, and branding — is owned by Notate and protected by applicable laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms. These Terms don't transfer any of our intellectual property rights to you.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements. You use the Service at your own discretion and risk.
9. Limitation of liability
To the maximum extent permitted by law, Notate and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
10. Termination
You can stop using the Service at any time by uninstalling the extension, which removes the data it stored on your device. We may suspend or end your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.
11. Changes to these terms
We may update these Terms as the Service evolves. When we do, we'll revise the "Last updated" date at the top of this page. Significant changes will be reflected here before they take effect, and your continued use of the Service after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws applicable where Notate operates, without regard to conflict-of-law principles. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
